The State of Minnesota has implemented the State Energy Code MSBC 1323 for commercial buildings effective January 5th, 2024. Due to the delay in the publishing of the Minnesota Commercial Energy Code book, applications for building permits for new, additions or alterations of buildings has been allowed to use the existing 2020 MSBC 1323. During this period, the City of Duluth Construction Services and Inspections has updated the Commercial Plan Review “Energy Compliance Worksheet” to reflect the changes to the Commercial Energy Code and will be requiring compliance under Minnesota Administrative Rules Chapter 1323.0005. During the transition, Construction Services and Inspections has teamed up with a third-party energy code consultant for plan review(s) and is also available for consultation for design professionals upon request to the Building Official.
Beginning 6/4/2024, the City of Duluth will delegate authority for residential and commercial electrical permitting and inspections to the State of Minnesota. All new electrical permits should be submitted through the Department of Labor and Industry website. Applicants who have electrical permits still requiring inspections must apply for a new electrical permit through the State of Minnesota. If you would like to request a refund for an incomplete City of Duluth electrical permit, please complete the refund request form.

Energy Code: The Minnesota State Energy Code changed at the beginning of the year and was made effective January 5th 2024.The new energy code is based on 2019 ASHRAE 90.1 The entire adopted Minnesota Rules, Chapter 1323, that became effective on Jan. 5, 2024 can be found here.
