SUBJECT: Repeat Burglar Arrested

NATURE OF INCIDENT: Home Burglary

INCIDENT TIME: 2239 hours
INCIDENT LOCATION: 1119 East 11th Street

On Saturday, November 21, 2009, at 10:39 PM, Duluth Police responded to 1119 East 11 Street on the report that an unknown male was just seen leaving the back door of the home carrying items. The neighbor calling said that the people who lived in the home were gone and the back door to the home was open. The male was last seen heading down 11th Avenue East from the alley.
 
Officers located Curtis Lee James Fairbanks, age 18 of Duluth at 11th Avenue East and 9th Street. Fairbanks was positively identified by the caller as the person seen leaving the back door of the home.  Fairbanks had entered the home through an open side window and was in the process of removing items from the home when he was seen by the neighbor.  Items taken include a 26” LCD TV, Xbox Gaming system, and other miscellaneous items. Some items were recovered in the alley behind the home.
 
Fairbanks was lodged at the St. Louis County Jail pending formal charges for Second Degree Burglary. The investigation into this incident is ongoing.
 
On November 20th of this year, Fairbanks was sentenced in Minnesota Sixth District Court to four years of supervised probation for a First Degree Burglary he committed on July 17th, 2009 and another four years of supervised probation for a 3rd Degree Damage to Property that he committed on April 8th, 2009.  The sentences are to run concurrently.  A second charge of Gross Misdemeanor Financial Transaction Card Fraud was dismissed in the First Degree Burglary incident.
