Former Kozy Owners Post Bond, Parties to Return to Court of Appeals
[Duluth, MN] The City of Duluth was notified today, Friday, February 14, that Dr. Ringsred and Respect Starts Here had posted the $50,000 bond before the court decided on emergency motions filed in court on Tuesday, February 11. The bond posting means that the City and the Duluth Economic Development Authority (DEDA) cannot proceed with demolition at this time.
“We are disappointed but will continue to defend the case vigorously in the Court of Appeals,” said City of Duluth Assistant City Attorney Elizabeth Sellers.
Last month, the court granted Dr. Ringsred and Respect Starts Here an injunction blocking the City and the DEDA from tearing down the Kozy while their appeal was pending. The court required a $50,000 bond as security for the injunction to take effect. Dr. Ringsred and Respect Starts Here did not immediately post the bond, leaving the path to demolition open. In the meantime, the City and DEDA continued to work towards demolishing the building including, this past Monday, February 10, passing a council resolution authorizing the City to enter a contract for demolition. On Tuesday, the court heard emergency motions filed by Dr. Ringsred, Respect Starts Here, and related plaintiffs in a case challenging the Kozy’s tax forfeiture and sale, seeking to stay demolition with a lower security amount.
